Which leads to a a pleading which is sometimes referred to as a defense of laches. In other words, because YOU delayed in making a claim, I am pleading the defense of laches, that is, too much time has expired and the lapse of time has been prejudicial to my ability to respond or to defend myself.
In effect, these are codified as statutes of limitations, but laches is itself (again if I recall correctly) a defense at common law as opposed to statute law.
